Constitutionalism and the War: From in Bello to post Bellum – 2024. XIІ Summer School

- Is it possible to hold elections under shelling? How can democratic legitimacy be ensured in times of war?
- Human rights may be restricted under the conditions of martial law; to what extent is this permissible and how can the legality of such restrictions be assessed?
- What threats does the war pose to the constitutional system? What safeguards does the Ukrainian constitutional system envisage to neutralize or mitigate them?
- How does the transition from wartime constitutionalism to a postwar constitutional order look like?
- What challenges will the process of European integration pose for the constitutional system of Ukraine?
These and other topics will be the subject of discussions during the XII Summer School "Rule of Law and Constitutionalism"; this year’s event will be devoted to constitutionalism in times of war and the postbellum period.
The OSCE Secretariat Extrabudgetary Support Programme for Ukraine together with the country’s Constitutional Court issues a call for applications for students and postgraduates from Ukrainian universities and think tanks wishing to participate in the Summer School.
The event will provide an opportunity for up to 30 students to review in detail the impact of the war on a variety of issues related to constitutional law, human rights, rule of law, as well as on resilience of constitutional order under extreme conditions.
Prominent experts in constitutional law, legal theory and philosophy and European case law will be invited to deliver lectures and presentations as part of the school, including judges of the Constitutional Court of Ukraine, experts of international organizations, justices of foreign constitutional court, renowned local and international scholars and practitioners.
The Summer School will offer its participants an intensive programme to improve their skills and knowledge in understanding, analysing, and interpreting constitutional principles, ideas, concepts as well as international human rights commitments.
Application for the School is open for students of law, but also those studying other humanities, such as political sciences, sociology, philosophy, and others. The deadline for application is 22 July 2024, 23:59 Kyiv time (EEST).
