About
Christian Tomuschat, former President of the Court of Conciliation and Arbitration within the OSCE and current Member of the Court’s Bureau, and Marcelo Kohen, Professor of International Law at the Graduate Institute of International and Development Studies in Geneva, will present the recently published study “Flexibility in International Dispute Settlement – Conciliation Revisited” and discuss with distinguished panelists the topic of conciliation as an adaptable method of settling international disputes.
The publication assembles the papers initially presented at a colloquium held in October 2018 in Geneva, which explored conciliation in a wider context. Conciliation is examined in selected fields of activity of the international community and incorporates experiences from Europe, Africa and Asia. The study takes stock of the successful revival of conciliation by looking closer at the case of Timor Leste v. Australia. The practices of inter-state disputes within human rights treaty bodies are highlighted. The publication also discusses the potential of the OSCE Court of Conciliation and Arbitration, which still remains to be fully activated.
