This publication is prepared for a series of training courses for judges of administrative courts of Ukraine on the application of the case-law of the European Court of Human Rights (ECtHR), as part of a project on “Safeguarding Human Rights through Courts” implemented by the OSCE Project Co-ordinator in Ukraine with the financial support of the Government of Canada. This edition presents the provisions of the European Convention on Human Rights (Convention) that are of utmost relevance in administrative proceedings. The provisions are disclosed through ECtHR judgements that interpret the Convention principles on the right to a fair trial (Article 6), protection of property (Article 1 of the First Protocol), the right to respect for private and family life (Article 8), freedom of expression (Article 10), freedom of assembly and association (Article 11). This publication is intended to help NGOs in conducting trial monitoring aimed at increasing public awareness about the functioning of the judicial system. It contains examples of foreign experience in application of this diagnostic tool. On the basis of methods developed by the OSCE Office for Democratic Institutions and Human Rights, and with due consideration of Ukrainian realities, the edition provides advice on organization of trail monitoring, its implementation in Ukraine and advocacy of the results. The publication also contains a sample of a monitoring questionnaire and an example of a filled questionnaire. List of recommended references will help to better understand the problematics of the mechanism of monitoring and evaluation of the functioning of judicial system. This educational and methodical manual- an introduction to the European Convention on Human Rights and the case-law of the European Court of Human Rights (ECtHR)- is the second edition containing three reviewed and updated sections. The first section contains FAQ and answers on how to file an individual application to the ECtHR. The second section explains basic regulations that relate to the protection of the rights and freedoms of a person or legal entity in ECtHR. The third section includes clarifications on how to fill in a new application to ECtHR and an example of such application. It is designed for lawyers, advocates, professors, state officials, judges and other audiences focusing on human rights and their effective protection at the international level.
