The analysis focuses on assessing the state of women's entrepreneurship and women's economic empowerment based on OSCE commitment (Ministerial Council, 7 December 2011: DECISION No. 10/11 PROMOTING EQUAL OPPORTUNITY FOR WOMEN IN THE ECONOMIC SPHERE) and the results of previous OSCE research in this field as well as the results of the analysis of existing support to women entrepreneurs, mapping of new forms of cooperation and recommendations given.The analysis starts from the fact that micro, small and medium enterprises, including those owned by women, are of vital importance for the economic and social development and sustainability of Serbian society. Survivors need to have confidence in the systems designed to identify and protect them, to give them the best chance of accessing services, staying with them and remaining safe. Therefore, NRMs should provide a structural set up for trauma-informed frameworks and procedures, and function as a natural ‘home’ for professional, trauma-informed methods of working. NRMs must ensure respect for the human rights and dignity of all adults and children who are victims of trafficking. There should be clear recognition in anti-trafficking law, policy and related guidance — and therefore recognition across all relevant NRM sectors and by all service providers — that victims of human trafficking should be treated as a distinct category of vulnerable people in need.

During the implementation of the current LCP, during trial monitoring activities and over discussion with national legal practitioners, it became obvious that one of the weaknesses among legal practitioners is the adequate use of expert opinions, expert witnesses and technical advisors as a tool for representing facts as evidence in Court, and their effective, efficient and financially justified conduct in accordance with the rules and principles of the national criminal procedure. The Law on Expertise, as lex specialis needs to be understood in the context of the LCP and the purpose of the expert witnesses during a criminal case trial. Therefore, the OSCE Mission to Skopje supported the drafting of this Guidebook for legal practitioners including positive and negative examples from the national court practice, ECtHR jurisprudence and additional elaborations of the novelties in the Law on Expertise.
