Report on the law on the justification of custody in BiH

Issued in August 2008, this report argues that the application of the Criminal Code of Bosnia and Herzegovina in all domestic war crimes proceedings would result in a more consistent and effective system of justice. It also sees a place in this system for a new, state-level judicial institution that would have the final say in the interpretation and application of the relevant law by all courts in the country. Such an institution would also help ensure consistency in the interpretation of the law and help guarantee equality be-fore the law.

Bearing in mind past practice in the RS, this report demonstrates the positive impact the Tunjice juvenile institution may have on the effective rehabilitation of juvenile offenders within the judicial and penal correctional system, which is one of the principles of the July 2006 National Strategy against Juvenile Offending. The report also points to remaining concerns regarding the treatment of juveniles in conflict with the law and respect for their basic human rights, as established by international instruments and reflected in Entity law.
