The publication aims at clarifying the procedural legal concept of shifting the burden of proof, its meaning and scope, as well as all open issues during practical implementation of the proceedings before the Commission for Prevention and Protection against Discrimination and the national court, to ensure effective application of the Law on Prevention and Protection against Discrimination. It also focuses on helping legal practitioners in acquiring knowledge and skills in the area of equality law and the principle on non-discrimination, thus examples from the Court of Justice of the European Union and the European Court of Human Rights, as well as comparative practices from European countries, are widely used.

The inclusion of national minorities in economic and social life is a crucial element of democracy, particularly in multi-ethnic societies, as it fosters unity and breaks down societal divisions. The High Commissioner on National Minorities’ Recommendations on the Effective Participation of National Minorities in Social and Economic Life offer practical tools to facilitate social and economic participation at different levels and in various settings.

Annex VI of the General Framework Agreement for Peace in Bosnia and Herzegovina envisages the role of the OSCE in monitoring the human rights situation in the country. This provision has served as the basis of the OSCE Mission to Bosnia and Herzegovina's (the Mission's) human rights monitoring over the past 25 years.

This factsheet describes how ODIHR works to promote gender equality in politics and democratic institutions.

This report presents a baseline assessment of environmental governance, taking into consideration an analysis of legal framework, institutional capacities, and technical expertise. The assessment was conducted from October 2022 to January 2023, by reviewing legal framework and literature, and interviews conducted with 25 institutions, and the validation of the findings in a technical consultation workshop with the participation of 40 attendees, representing compliance and management agencies, police, prosecution, civil society, media and academia. Also, baseline assessment highlighted the opportunities and concrete recommendations to enhance inter-institutional co-operation and environmental law enforcement. January 2023

The OSCE Mission to Bosnia and Herzegovina monitors and reports on hate crimes and bias-motivated incidents, advocates for the effective application of legal provisions on hate crimes, raises awareness amongst institutions and the public and builds the capacity of domestic institutions to prevent and process such cases.

As part of its ongoing support to Ukraine, the OSCE Office for Democratic Institutions and Human Rights (ODIHR) has conducted a survey of close to 1,000 Ukrainian refugee women to ensure their experiences and vulnerabilities are reflected in policies to address human trafficking in the OSCE region.

The publication comprises the internal and external assessments of the activities and the structure of the Academy for Judges and Public Prosecutors (AJPP). The internal assessment is focused on evaluating the decision-making processes, the management bodies, and the structure of the employees. This also includes the assessment of the training needs of management bodies and the employees of the AJPP, to raise their knowledge about diversity and gender equality. The analysis of the external activities assesses whether diversity and gender equality are included in the overall training conducted at the AJPP, including the bylaws for initial and continuous education and training, as well as the annual curriculums.
