OSCE promotes application of freedom of expression standards in judicial practice in Kazakhstan
ASTANA, 19 June 2014 – An OSCE-supported training seminar on enhancing the efficiency of the judicial system in applying international standards on freedom of expression began today in Astana.
The two-day event was co-organized by the Centre in Astana in co-operation with the Supreme Court, the International Foundation for Freedom of Speech Adil Soz, and the human rights organization ARTICLE 19 for some 30 Supreme Court judges and judges from across the country.
Participants will learn about the practical application of the International Covenant on Civil and Political Rights provisions. A judge from the European Court of Human Rights, national and international experts will help them better understand the international principles of Internet regulation and access to public information and how current national legislation of Kazakhstan guarantees freedom of expression. They will also discuss the decisions of the UN Human Rights Committee and the European Court of Human Rights.
“Freedom of speech is a fundamental human right. Any limitations of freedom of expression should be established by the court in strict accordance with legislation,” said Ambassador Natalia Zarudna, Head of the Centre in Astana. “This seminar will equip judges with practical knowledge on the application of international standards and explore the meaning of the provisions of the International Covenant on Civil and Political Rights related to freedom of expression and its interpretation in international law.”
Kairat Mami, Chair of the Supreme Court noted: “The Constitution of Kazakhstan guarantees the freedom of speech and protection of honour and dignity in compliance with international standards, and in all democratic countries judicial bodies have to deal with difficult cases related to the violation of these rights”. He added that “this seminar will help to exchange experiences between Kazakh and European judges on handling such cases.”
The seminar is part of the OSCE Centre’s efforts to assist the host country in enhancing the effectiveness of the judiciary and promoting the rule of law.
