Amendments to Tajikistan criminal code discussed at round table

DUSHANBE, 17 April 2001 - Amendments to the draft new Criminal Procedure Code of the Republic of Tajikistan were the subject of a two day round table held in Dushanbe from 16 to 17 April 2001.
The round table was organized by the Organization for Security and Co-operation in Europe (OSCE) Mission to Tajikistan in the framework of the OSCE Office for Democratic Institutions and Human Rights (ODIHR) project of legislative assistance to Tajikistan.
Participants included representatives of the ODIHR, international experts and members of the Tajikistan Government Working Group on the Criminal Procedure Code.
The main goal of the round table was to consider the draft of a new Criminal Procedure Code in light of the international commitments that Tajikistan has signed in the field of human rights, especially the International Covenant on Civil and Political Rights.
The adoption of a new Criminal Procedure Code is an integral part of the legal reform in Tajikistan and an important step towards bringing the national legislation into conformity with the 1994 Tajik Constitution and international standards. In 1998 Tajikistan adopted a new Criminal Code and in 1999 - a new Civil Code. Several other important legal documents, including the new Criminal Procedure Code, are at different stages of elaboration.
During the round table, OSCE experts and the members of the Working Group discussed such issues as pre-trial investigation (arrest, the warrant issuing agency, conditions and duration of the arrest, pre-trial arrest, habeas corpus, right to information and caution), the role of Prosecutor and Defender in pre-trial investigation and the trial, and the trial and appeals processes.
The Working Group assured the OSCE that all concerns expressed by the international experts would be taken into account during the preparation of the final version of the new draft of the Criminal Procedure Code.
