The publication presents the results of "Research on Gender Discrimination in the Professional Environment of Advocates and Judges" based on the analysis of questionnaires filled in April- June 2015 by the participants of the trainings on the application of the case-law of the European Court of Human Rights. The publication offers an overview of existing legal framework, with emphasis on key international legal acts and laws of Ukraine on ensuring gender equality and non-discrimination. It also presents analysis of the forms of statistical reporting with regard to availability of gender-segregated data and national courts’ practice in cases on gender discrimination; it also outlines relevant case-law of the European Court of Human Right. The publication provides recommendations for judges and advocates on implementation of the principle of gender equality in their work. This publication is not available in English.

The quality of laws is a direct consequence of how they are developed and discussed. Lawmaking procedures and practices should follow democratic principles, adhere to the rule of law and comply with international human rights obligations and standards. At the same time, they should be evidence-based, open and transparent, participatory and inclusive, and subject to effective oversight.

This publication represents a compilation of presentations and materials following the international conference on “Property Right: European Experience and Ukrainian Realities”, held in Kyiv on 22-23 October 2015 and organized by the OSCE Project Co-ordinator in Ukraine jointly with the Supreme Court of Ukraine, EU Project “Support to Justice Sector Reforms in Ukraine”, and the Law Faculty of the Taras Shevchenko National University of Kyiv, as part of the OSCE project “Safeguarding Human Rights through Courts” funded by the Government of Canada. This publication is intended to help NGOs in conducting trial monitoring aimed at increasing public awareness about the functioning of the judicial system. It contains examples of foreign experience in application of this diagnostic tool. On the basis of methods developed by the OSCE Office for Democratic Institutions and Human Rights, and with due consideration of Ukrainian realities, the edition provides advice on organization of trail monitoring, its implementation in Ukraine and advocacy of the results. The publication also contains a sample of a monitoring questionnaire and an example of a filled questionnaire. List of recommended references will help to better understand the problematics of the mechanism of monitoring and evaluation of the functioning of judicial system. The publication was prepared for a series of trainings for Ukrainian judges of courts of common jurisdiction on application of the case-law of the European Court of Human Rights (ECtHR), within the project "Safeguarding Human Rights through Courts" implemented by the OSCE Project Co-ordinator in Ukraine with the financial support of the Government of Canada.
