The legal review, commissioned by the OSCE Representative on Freedom of the Media from Professor Yaman Akdeniz, an internationally renowned expert on Internet freedom, assesses the Article in light of the above international treaties and offers ways to improve the legislation governing Internet freedom in Turkey. Its main recommendation is to refrain from adopting Article 73 in its current form, and to focus further discussion on licensing that is based on a “notification model” instead of a system of a priori control where media service providers and platform operators would be required to obtain a licence from the Radio and Television Supreme Council (“RTÜK”).

It is important to now what is a hate crime. When a hate crime is committed, one or more perpetrators target the victim, which can be one or more people or property, because of a protected aspect of the victim's identity, such as religion or ethnicity, race, sexual orientation or disability. Similarly, a hate incident is an act of hostility motivated by prejudice or bias that does not necessarily reach the threshold of a criminal offence, or the criminal nature of which is yet to be determined. A hate crime is any crime where the perpetrator is driven by prejudice or bias. Criminal offence + bias motive = hate crime.

The legal analysis of the draft law “On Changes to Some Legislative Acts of Ukraine on Countering Threats to National Security in the Information Sphere” was commissioned by the Office of the OSCE Representative on Freedom of Media and carried out by Dr. Joan Barata Mir, independent media freedom expert from Spain. The analysis notes some problematic areas in the draft law with regard to freedom of expression, such as a lack of judiciary oversight and due process regarding decisions affecting access to and dissemination of content, and offers a number of recommendations that would ensure compliance of the legislation with the OSCE commitments and international standards.
