This Opinion was prepared in response to a request from the President of the Committee for Auditing Democratic Quality, the Fight against Corruption and Institutional and Legal Reforms of the Congress of Deputies of Spain sent to the OSCE Office for Democratic Institutions and Human Rights in May 2017.

The Joint Opinion raises key issues and provides indications of areas of concern. In the interests of concision, the Joint Opinion focuses more on problematic areas rather than on the positive aspects of the draft Amendments. The ensuing recommendations are based on relevant international human rights and rule of law standards and OSCE commitments, Council of Europe and UN standards, as well as good practices from other OSCE participating States and Council of Europe member states. Where appropriate, they also refer to the relevant recommendations made in previous OSCE/ODIHR and Venice Commission opinions and reports.

This Joint Opinion was prepared by the European Commission for Democracy Through Law (Venice Commission) and the OSCE Office for Democratic Institutions and Human Rights (ODIHR) at the request of the Chairperson of the Parliament of Georgia.

This Opinion was prepared in response to a request from the Permanent Mission of Switzerland to the OSCE in Vienna received by the OSCE Office for Democratic Institutions and Human Rights in July 2017.

At the outset, the OSCE/ODIHR notes that the Law generally complies with international anti-corruption standards, as well as with relevant OSCE commitments. Some improvements may be considered, in particular: • no outside body or actor should control or influence the Bureau; • limiting the appointment of the Head of Bureau to a single term; • creation of one or more advisory committees; • mechanisms of the Bureau should be strengthened in the course of its investigations.
