Workshop on property issues held in Kosovo

PRISTINA, 28 February 2001 - A workshop aimed at untangling some of the administrative problems facing property issues in Kosovo was held by the Organization for Security and Co-operation in Europe and the Kosovo Judicial Institute recently.
The meeting focused on the theme "The Jurisdiction between Housing and Property Directorate and the Kosovo Courts". The aim was to find solutions to clarify jurisdictions of the different institutions relating to property.
Property is one of the most complex areas of the law and often the approaches of various authorities to the problem have been inconsistent. The courts in Kosovo have the authority to deal with most property issues, however they are just beginning to function again. As a result, the Housing and Property Directorate was created by United Nations Mission in Kosovo to handle residential property issues.
Participants in the workshop included reresentatives from the Housing and Property Directorate, the Department of Judicial Affairs, and 21 judges from the regions in Kosovo - all with a background in property law. Presentations were given on the role of the Housing and Property Directorate, its property claims procedure and its jurisdiction.
Two sessions were intended to identify the problematic property claims cases and focus on clarifying the various jurisdictions relating to property issues. The ideas and suggestions presented will be used by the Department of Judicial Affairs to improve the co-ordination and co-operation between the Housing and Property Directorate and the courts. As a pilot project, information gathered from the workshop will also be used by the Kosovo Judicial Institute as it designs a course on property issues as part of its legal education programme.
The Kosovo Judicial Institute was set up by the OSCE, the Institution Building Pillar within UNMiK, to provide legal education for judges and prosecutors, thus playing an important role in strengthening the independence of the judiciary and rule of law in Kosovo.
