Sanctions on two political parties in Bosnia and Herzegovina

SARAJEVO, 8 November 2000 - At its 287th meeting on November 7, the Provisional Election Commission (PEC) sanctioned two political parties for violations of the Law on Party Financing.
The SDS received two contributions totalling 40,000 KM from the Man Co in the month of September. The PDP received 50,000 KM from TRGO Komerc2 in October. Those contributions violate the contribution limit established by the Law on Party Financing that was adopted by the Parliamentary Assembly of BiH on July 31. Under the law, individuals and private companies are only permitted to contribute eight times the average monthly workers salary, which equals 3.,656 KM. The law authorises the Provisional Election Commission to enforce its terms until such time as a permanent election commission is established. Both parties were ordered to return the excess amount of the contributions to the contributors within seven days or face further sanction by the PEC.
The PEC also referred both cases to the Election Appeals Sub-Commission (EASC) to investigate whether either of the companies was publicly owned according to the definition in Article 1606 of the PEC Rules and Regulations. Publicly owned companies are prohibited from contributing to political parties and these two parties could face additional sanctions by the EASC if it determines that these companies have more than 25% public ownership.

In accordance with the General Framework Agreement for Peace (GFAP), the OSCE Mission activities are to: promote Democratization and he Building of a vibrant civil society, foster the development of professional journalism and monitor the rights of journalists, monitor and advance the Human Rights situation, supervise the conduct of Elections, and encourage Regional Stabilization through arms control and confidence and security-building measures. The OSCE Mission continues to work closely with other international organizations and local institutions to implement the Dayton Peace Accords.
