Cassation system and appealing to higher courts in Germany: Study visit for Belarusian judges

The purpose of this study visit is to familiarize a group of judges and court specialists from Belarus with the system of cassation (appeals to higher courts) in Germany.
The five participants (three men and two women) will look at various national solutions to common challenges in the administration of cassation and have the opportunity to strengthen their professional contacts. The participants will learn about specifics of cassation in Germany as well as the role of different level courts such as the Federal Constitutional Court, the Federal Court of Justice and the High Regional Court of Karlsruhe.
The study visit will include an overview of the German judicial system and cassation procedures, restrictions on access to cassation and limits of authority of cassation bodies. The study visit aims to support the Belarusian authorities in expanding further guarantees related to access to court, thus ensuring better implementation of the right to a fair trial for Belarusian citizens.
The study visit is part of the rule of law component of the ODIHR project Promoting Democratization and Human Rights in Belarus funded by the European Union. It is the second in a series of three study visits on rule of law and other justice-related issues envisaged in the project.
