Od uvođenja 2003. godine, sporazumi o priznanju krivnje su postali jedan od ključnih instituta u okviru kaznenog postupka u Bosni i Hercegovini. Kao dio sveobuhvatne reforme kaznenopravnog sustava, ovaj institut zasnovan na anglosaksonskom običajnom pravu omogućava tužiteljima i osumnjičenim, odnosno optuženim da pregovaraju o vrsti i dužini kaznenopravnih sankcija, uz uvjet da osumnjičeni, odnosno optuženi prizna da je počinio kazneno djelo i pristane da se odrekne određenih osnovnih prava kao što su pravo na javnu raspravu pred sudom na osiguranje javnog sudskog postupka i pravo na žalbu. Nakon skoro dvije godine praćenja postupaka u svezi sa zaključenjem sporazuma o priznanju krivnje, Misija Organizacije za europsku sigurnost i suradnju („OESS”) je mišljenja da razvoj događaja u primjeni ovog instituta zaslužuje potpunu i detaljnu analizu. Ovo tematsko izvješće fokusirano je na razmatranje stupnja do kojeg je primjena ovog instituta usklađena sa osnovnim međunarodnim standardima za zaštitu ljudskih prava, uključujući pravo na pravično suđenje, zagarantirano člankom 6. Europske konvencije o ljudskim pravima. U tom smislu, izvješće ima za cilj da pomogne praktičarima u utvrđivanju spornih oblasti u njegovoj primjeni i pronalasku mogućih praktičnih rješenja, kao i da pruži više informacija široj javnosti o samom postupku.
