This publication is the second in a series of publications containing selected cases from the practice of both courts, and is a natural evolution in the process of strengthening the capacities of Macedonian judges. Considering the 13 cases that were worked out in detail in the first publication in 2013, the effect it had among judges, lawyers, students and other legal practitioners as well as its vast applicability in practice, the publication aims to upgrade already acquired knowledge and further enhance the prohibition and prevention of discrimination in practice. This assessment provides an overview of the work of the Specialized Department of the Basic Court Skopje I Skopje dealing with organized crime and corruption throughout the former Yugoslav Republic of Macedonia. The analysis focuses on the work of the Specialized Department from 2007 until early 2014 and seeks to evaluate the work of this Department regarding the types of cases adjudicated and the type and distribution of sentences related to these cases.

The Guidebook is focused on several aspects, in particular the phenomenon of electronic communication and replacement of the conventional system of stream data with a new one, which enables the transfer of large scale data in a faster and more efficient way. The Guidebook is not intended to give step by step instructions, but the idea is to offer a useful tool- a guide that contains terms facilitating the identification of tools committing this type of crime, and the type of provided evidence in a correct way, which would facilitate the process of proof. The Guidebook is primarily targeting prosecutors, but it has been made available also to the criminal law judges and defence attorneys as well.

This analysis of the practical application of pretrial detention, as well as of the theoretical legal framework laid down in the Criminal Procedure Code1 of 2010 (hereinafter referred to as CPC 2010), which introduced conceptual reforms of national criminal procedure legislation, introducing elements typical of accusatorial systems, is the result of the cooperation between the Macedonian Association of Criminal Law and Criminology and the OSCE Mission to Skopje Rule of Law Department. The information in the analysis refer to the first nine months of enforcement of the CPC 2010, namely to the period between 1 December 2013 and 31 August 2014, and to four basic courts (Bitola, Gostivar, Skopje and Shtip). The publication is in English, Macedonian and Albanian languages.

The publication is integral part of project activities in the frames of cooperation between the State Commission for Prevention of Corruption (SCPC) and the OSCE Mission to Skopje in 2013 and 2014. It contains a total of five qualitative analysis conducted on the basis of National Integrity System (NIS) methodology of Transparency International, as well as three public opinion polls conducted by the Rating Agency to screen the citizens perception about the existence of corruption in selected sectors of the State Programme for Prevention and Repression of Corruption and Conflict of Interest 2011-2015.

The Analytical Report on the Implementation of the Decentralization Process is the result of a field research and desk analysis which were conducted by the Democratic Governance Unit of the OSCE Mission to Skopje during the period July 2012 and July 2013. It grounds its findings on a survey questionnaire (field research) in selected municipalities, a desk review completed on the basis of written materials collected at central government institutions, legal analysis and roundtable discussions with relevant stakeholders. The aim of the Report is to assess the progress made in decentralization process implementation in specific key reform areas related to the Ohrid Framework Agreement.
