The scope of these Comments focuses mainly on the proposed changes relating to the institution of advocacy but does not go into other aspects addressed in the Draft Degree and Concept, notably amendments to criminal procedure, taxation laws, or legislation on legal aid.

The Opinion raises key issues and provides indications of areas of concern. In the interest of conciseness, it focuses more on areas that require amendments or improvements than on the positive aspects of the Draft Law. The ensuing recommendations are based on international standards, norms and practices as well as relevant OSCE human dimension commitments.

This Joint Opinion was prepared by the Council of Europe's Venice Commission and the OSCE Office for Democratic Institutions and Human Rights (ODIHR) following a request from the President of the National Assembly of Armenia. The Joint Opinion was adopted by the Venice Commission on 20 March 2020 through a written procedure which replaced the 122nd session of the Venice Commission, due to the COVID-19 disease and following consultation of the Council for Democratic Elections.

In a democratic society, the rule of law is guaranteed by the fair, impartial and effective administration of justice. Such administration of justice requires independent and impartial judges and public prosecutors who ensure that individual rights and freedoms are guaranteed, and public order is protected.
